State Level RTI: Sikkim

In May 2005, the national Right to Information Act 2005 was passed by Parliament. The RTI Act 2005 received Presidential assent on 15 June and came fully into force on 12 October 2005. The RTI Act 2005 covers all Central, State and local government bodies and applies to the State Government of Sikkim.

The Sikkim Government has started implementing the RTI Act 2005.

The Government has issued the Sikkim State Right to Information (Regulation of Fee, Costs and Miscellaneous) Rules, 2005.

The High Court at Sikkim notified The High Court of Sikkim Right to Information (Regulation of Fee, Cost and Miscellaneous) Rules 2007 which was published in the Sikkim Gazette on 23 May 2007 and came in to effect from that day.

A-4/A-3 paper, photocopied or larger size paper created

Rs 10 per page plus postal charges (No postal charges if the requestor collects it in person)

Information in printed form

Price fixed for publication or Rs 5 per page of photocopy for extracts form the publication plus postal charges. (No postal charges if the requestor collects it in person)

Large size paper

Actual cost plus postal charges (No postal charges if the requestor collects it in person)

Floppy/disk or any other electronic mode

Rs 50

Documents, samples, models, maps plus postal charges

Fixed Price by the concerned Department

Inspection of records

Free for first hour, Rs 5 for each 15 minutes or a fraction thereof

Appeal Fees:

 

First appeal to Appellate Authority

Rs 100

Second appeal to SIC

Rs 100

Second Appeals and complaints against non-disclosure of information may be filed with the Sikkim State Information Commission.
